1. Introduction and Acceptance

Welcome to NextSelf Labs. These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the website located at nextselflabs.com (the "Site") and the purchase of any products offered by NextSelf Labs ("we," "us," "our," or the "Company"). By accessing the Site or placing an order, you ("you," "Customer," or "Researcher") agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase any products from us.

These Terms constitute a binding legal agreement between you and NextSelf Labs.

3. Research Use Only Designation

This is the most important section of these Terms. Please read it carefully.

All products sold by NextSelf Labs are intended strictly for in-vitro laboratory and scientific research use only. They are sold as research chemicals and are not intended for any of the following uses:

Human consumption (including ingestion, injection, inhalation, or topical application to humans)
Veterinary use or administration to any animal
Therapeutic, diagnostic, or preventive use in humans or animals
Cosmetic use or application
Use as a food additive, dietary supplement, or component thereof
Use in any clinical setting on living subjects

Our products have not been evaluated, approved, or otherwise cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory authority for any human or veterinary use. No claims are made or implied regarding the safety or efficacy of any product for any use other than in-vitro laboratory research.

By purchasing any product from NextSelf Labs, you affirm and represent that:

a) You are a qualified researcher, scientist, or laboratory professional, or an authorized representative of a research institution;

b) You are at least 21 years of age;

c) You will use the product solely for legitimate in-vitro laboratory or scientific research purposes;

d) You will not consume the product, administer it to any human or animal, or otherwise use it for any purpose involving living subjects;

e) You will handle, store, and dispose of the product in accordance with applicable laws, regulations, and accepted laboratory practices;

f) You understand that misuse of research chemicals may result in injury, illness, or death, and you assume all risk associated with your use of the product;

g) You are not purchasing the product on behalf of, or with the intent to redistribute to, any party who would use the product for any purpose prohibited under these Terms.

4. Eligibility and Account Creation

To purchase products from the Site, you must be at least 21 years of age and legally capable of entering into binding contracts under the laws of your jurisdiction. By placing an order, you represent and warrant that you meet these requirements.

If you create an account on the Site, you are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Promptly notifying us at support@nextselflabs.com of any unauthorized use of your account
Providing accurate, current, and complete information during registration and at the time of any purchase

NextSelf Labs reserves the right to refuse service, terminate accounts, cancel orders, or limit purchases at our sole discretion, including without limitation in cases where we suspect fraudulent activity, misuse of products, or violation of these Terms.

5. Product Information and Availability

We make every reasonable effort to display product information accurately on the Site, including descriptions, images, pricing, and availability. However, we do not warrant that product descriptions, certificates of analysis, or any other content on the Site is complete, current, or error-free.

Products are subject to availability. We reserve the right to:

Modify or discontinue any product without notice
Limit quantities of any product purchased per customer, household, order, or time period
Refuse or cancel any order at any time, including after order confirmation
Correct any errors, inaccuracies, or omissions in product information or pricing

Photographs and imagery on the Site are for illustrative purposes. Actual products may vary in appearance, particularly with respect to lyophilized peptide presentation, vial labeling versions, and packaging.

6. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, shipping fees, or duties unless otherwise stated.

Payment is due at the time of order placement. We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount, including any applicable taxes and shipping fees.

In the event of a pricing error on the Site, we reserve the right to cancel any order placed at the incorrect price, regardless of whether the order has been confirmed or charged. We will notify you promptly of any such cancellation.

7. Shipping, Delivery, and Risk of Loss

We currently ship within the United States only. Shipping methods, costs, and estimated delivery times are displayed at checkout and may vary based on your location, order contents, and selected shipping option.

Title and risk of loss for all products pass to you upon delivery to the carrier at our facility. You are responsible for inspecting your shipment promptly upon delivery and for filing any claims for damage, loss, or non-delivery directly with the carrier.

We are not responsible for:

Delivery delays caused by carriers, weather, customs, or other circumstances beyond our control
Lost or stolen packages once marked as delivered by the carrier
Failure to provide an accurate or complete shipping address at checkout
Refusal of delivery or failure to retrieve packages from carrier facilities

Customers ordering from outside the United States do so at their own risk. International shipments may be subject to customs inspection, duties, taxes, or seizure, and we make no representations about the deliverability of products to any specific international destination.

8. Returns, Refunds, and Cancellations

Due to the nature of research chemicals and the requirement to maintain chain-of-custody for laboratory reagents, all sales are final. We do not accept returns of opened products.

We may, at our sole discretion, accept returns or issue refunds in the following limited circumstances:

The product was damaged in shipping (claim must be made within 7 days of delivery, with photographic evidence)
The product received does not match the product ordered (notification required within 7 days of delivery)
The product fails to meet its published Certificate of Analysis specifications

To request a return or refund under these circumstances, contact support@nextselflabs.com with your order number and a description of the issue. Returns will not be accepted without prior written authorization from NextSelf Labs.

Order cancellations may be requested by emailing support@nextselflabs.com prior to shipment. Once an order has shipped, it cannot be cancelled.

Refunds, when issued, will be processed to the original payment method within 5 to 10 business days of return receipt or approval.

9. Quality Assurance and Certificates of Analysis

We test every batch of our products through independent third-party laboratories using HPLC and mass spectrometry. The current batch's Certificate of Analysis is published on each product page, and the batch number on each vial label corresponds to the published COA.

While we make every reasonable effort to ensure product quality and accurate documentation, we make no warranties beyond those expressly stated in these Terms or in the published Certificate of Analysis for the specific batch you receive.

10. Intellectual Property

All content on the Site, including but not limited to text, graphics, images, logos, product photography, written copy, blog content, the NextSelf Labs name and logo, and the Site's design and code, is the property of NextSelf Labs or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our express prior written permission, except that you may temporarily store copies of materials in RAM, store files for personal use, and print or download one copy of a reasonable number of pages for personal, non-commercial use.

The names "NextSelf Labs" and "NextSelf" and any associated logos, taglines, or product names are trademarks of NextSelf Labs and may not be used without our express prior written permission.

11. User Conduct and Prohibited Uses

You agree not to use the Site or any product purchased from us to:

Violate any applicable federal, state, local, or international law or regulation
Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
Attempt to gain unauthorized access to the Site, accounts, or computer systems
Use the Site to transmit viruses, malware, or other harmful code
Engage in fraudulent activity, including misrepresenting your identity or qualifications as a researcher
Resell or redistribute products in violation of these Terms or any applicable law
Harvest, collect, or store information about other users of the Site without their consent

We reserve the right to investigate suspected violations of these Terms and to cooperate with law enforcement authorities in any investigation.

12. Disclaimers and Limitation of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTSELF LABS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, NextSelf Labs makes no warranty that:

The Site will meet your requirements or be available on an uninterrupted, secure, or error-free basis
Any results from the use of any product will be accurate, reliable, or suitable for any purpose other than in-vitro laboratory research
Any product is suitable for human consumption, therapeutic use, cosmetic use, or any use other than in-vitro laboratory research
Defects in the Site or any content will be corrected

The information published on the Site, including blog content, research summaries, product descriptions, and educational material, is provided for informational and educational purposes only. It does not constitute medical, legal, or professional advice and should not be relied upon as such. Always consult a qualified healthcare provider for any decisions regarding personal health.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXTSELF LABS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCT.

IN NO EVENT SHALL NEXTSELF LABS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR ANY PRODUCT EXCEED THE TOTAL AMOUNT PAID BY YOU TO NEXTSELF LABS DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, INCLUDING CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND REGARDLESS OF WHETHER NEXTSELF LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless NextSelf Labs, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorneys' fees) arising from:

a) Your use of and access to the Site or any product;

b) Your violation of any term of these Terms;

c) Your violation of any third-party right, including without limitation any intellectual property right or privacy right;

d) Any claim that your use of any product caused damage to a third party, including any claim related to use of a product for any purpose other than in-vitro laboratory research;

e) Any false representation made by you regarding your status as a researcher, your age, or your intended use of any product.

This defense and indemnification obligation will survive these Terms and your use of the Site.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site or any product shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona, and judgment on the award may be entered in any court having jurisdiction.

You agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration against NextSelf Labs.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or restrain infringement of intellectual property rights.

16. Modifications to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through a notice on the Site or via email to registered account holders.

Your continued use of the Site or purchase of any product after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Site and refrain from making further purchases.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and NextSelf Labs regarding the use of the Site and the purchase of any product, and supersede any prior agreements between you and NextSelf Labs on these subjects.

19. No Waiver

The failure of NextSelf Labs to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of NextSelf Labs to be effective.

20. Force Majeure

NextSelf Labs shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including without limitation acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, disease, strikes, shortages of transportation facilities, fuel, energy, labor, or materials.

21. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms at any time without notice or consent.
